Terms and Conditions
The following Terms and Conditions are important, please read them thoroughly and carefully. These Terms and Conditions are substantially similar to those of the Guest Agreement. Each Tour Guest must read and agree to a Guest Agreement outlined below to complete their tour registration. A Tour Guest Agreement will be sent to you for your signature. Guest Tour registration signifies your approval of Private Label Tours, LLC Terms and Conditions.
Private Label Tours, LLC (”PLT”) develops, conducts and sells tour packages described as, hereinafter referred to as “Tour(s)” in cooperation with various individuals, organizations, entities and businesses who may license, market, promote, and advertise these Tours displaying their specific brand, identity, name or trade name, hereinafter referred to as “Tour Partners”. “Guest” refers to the person named and whose signature appears below. PLT contracts with various hotels, restaurants, instructors, operators, transportation companies, contractors, or other service providers named, or unnamed, hereinafter referred to as “Vendors”. PLT and Tour Partners are not responsible for acts or omissions of other Tour Guests, Vendors or their failure to provide services or adhere to their own policies. The Vendors or independent contractors providing transportation, accommodations and all other services are not agents or employees of PLT or Tour Partners. By utilizing the services of any and all Vendors, the Guest agrees that neither PLT or Tour Partners, nor any of their respective owners, managers, officers, employees, affiliates, independent contractors or representatives shall be liable for any accident, injury, or loss. This includes loss of life, illness, damages, delay, loss, damages or expenses arising from acts of God, strikes, war, weather, quarantines, sickness, terrorist activity, government restrictions or regulations, from any act or omission of any individual, business, or corporation providing transportation, charters, guiding, viewing, instruction, entertainment, activities, demonstration or accommodations, or any services in connection with Tour, or from any other occurrences whatsoever. All such expenses or losses are the responsibility of the Guest. By participating in a Tour, the Guest willingly assumes all risks and responsibilities expected or unexpected involved with such Tour. PLT and Tour Partner strongly suggest Guest purchase travel insurance to protect against such risks, including Tour cancellation due to unanticipated events or circumstances.
Tour Prices: All Tour prices are in US Dollars, are per person and based on double occupancy. Single supplement pricing is available in most cases. Tour prices are listed for each Tour but are subject to change, until full payment is received by Guest. Each Tour description lists the items that are included on that individual Tour. Please refer to the Tour description for pricing and inclusions.
Costs Not Included in Tour: Those items not listed in the Tour description are NOT included in the Tour price, including but not limited to, the following: passport, visa & custom fees, airfare, airline and airport taxes & fees, luggage fees; personal items and services including but not limited to, transportation, medical care and/or services, phone calls, lodging, lodging internet fees, lodging, spa, golf or any amenity or usage fees, parking, room service, laundry, meals and beverages other than those included in the itinerary, Travel, Health, Accident, Baggage & Trip Cancellation Insurance, and all other products or services not listed in the Tour description.
Air Transportation: Airfare and transportation is NOT included in the Tour price unless otherwise noted in the Tour description. Guest is responsible for arrangement and payment of their air transportation to the Tour destination unless alternate transportation is provided as described in the Tour description.
It is the responsibility of each Guest to arrive at the Tour at the scheduled date and time. PLT and/or Tour Partners shall not be liable for additional costs incurred by the Guest because of any changes in airline schedule or delays which may necessitate additional lodging nights being added to Guest’s Tour, airfare changes, cancellations, or overbooking. All claims for any loss, injury or damage suffered on any airline must be made directly with the airline involved and not PLT and/or Tour Partner. If a Guest fails to arrive at the Tour in time and as a result is unable to participate in the Tour, fully or in part, or must travel to meet the Tour, no refund or compensation will be due or paid to Guest.
Transportation and Transfers: The type of transportation we utilize varies by Tour, destination, group size, and dates. Transportation strictly departs at stated times and dates. Please ensure you are at the appropriate location for transfer and/or transport at the stated time. Transfers may not be included. Please check the specific Tour description and/or itinerary. In the event Guest misses a scheduled departure for any Tour, transfer or event, it is Guest’s sole responsibility to arrange and pay for transportation to the next arrival/departure point or hotel to begin or rejoin the scheduled Tour/itinerary. No refunds or compensation will be issued for missed transportation or the delayed arrival of Guest.
Baggage: Guests must conform to all international/domestic air carrier restrictions, excess baggage fees, and are responsible for their own baggage during the Tour, unless in the contracted care of Vendors. Many Tours, or portions thereof, include porterage when arriving and departing lodging accommodations. Please consult the Tour description. PLT and Tour Partner recommend one bag/suitcase per Guest, plus a small carry-on and necessary Tour equipment, i.e. golf bag., etc. PLT and Tour Partner strongly suggest that Guest purchase travel insurance with baggage protection.
Tour Payment: Tour payment(s) and non-refundable deposit shall be in US Dollars and may be made by PayPal or MasterCard, Visa, Discover, American Express credit/debit card, or by check drawn on a US account, or by any other method PLT authorizes in writing. Payment by check is not considered received until all funds have been made available. If a check is returned for any reason including, but not limited to insufficient funds or “stop payment,” all reservations covered by the check will be considered canceled, and the Guest will be responsible for a $45 service charge. Full payment is due 60 days prior to Tour departure unless stated otherwise. The full payment date will be included on Guest’s invoice.
Tour Deposit: Each Guest is required to make a non-refundable deposit of $400 (Four Hundred Dollars) to register for a Tour. A reservation will not be considered guaranteed until full Tour payment is received by PLT on Guest’s account. The non-refundable deposit will be applied to Guest’s Tour purchase price. The balance of the monies owed will be provided on Guest’s invoice. In the event of Guest’s Tour cancellation, the non-refundable deposit may be applied once as a non-refundable deposit on any future PLT Tour departing within one year of the canceled Tour’s departure date. Thereafter, the non-refundable deposit may not be applied to any future Tour offered by PLT. Please refer to applicable paragraphs below.
Credit/Debit Card Required: Each Guest shall provide to PLT a valid MasterCard/Visa or American Express credit card’s information, with sufficient credit availability, issued in Guest’s name, 30 days prior to Tour departure date. This credit card information will be provided to lodging accommodation providers for use as a room security deposit and for Guest’s incidental room charges, per each accommodation provider’s policy. Please refer to Costs Not Included in Tour paragraph above.
Changes to Reservation: Once a non-refundable deposit payment has been made for a Tour registration, all Tour registration change requests must be received in writing. PLT will use its best efforts to secure requested changes. PLT is subject to the rules and fees of third-party Vendors and thus change requests are not guaranteed. If change is possible, all additional Vendor’s fees will be added to the Guest’s Tour cost.
Cancellation Fees: Unless stated differently on the Tour invoice, a Guest providing a written cancellation notice, received at least 60 days prior to Tour departure date, will be allowed, (exempting the $400 non-refundable deposit), a full refund of all monies paid by Guest, or on Guests’ behalf, less a 5% processing and handling fee. Thereafter, total cancellation fees are as follows:
60 to 30 days prior to departure = 50% of Tour cost
29 to 15 days prior to departure = 75% of Tour cost
14 or fewer days prior to departure = 100% of Tour cost, including no-shows.
In the event Guest’s Tour reservation vacancy shall be filled by another paying Tour Guest, without cancellation, PLT Shall refund (exempting the $400 non-refundable deposit), all cancellation fees paid by Guest, or on Guest’s behalf, minus any discount amount granted by PLT to secure another paying Tour Guest. Cancellation refund payments shall be paid no later than 30 days after Tour departure date. All other refunds to Guest, due to Guest cancellation, will be made within 30 days of receipt by PLT or of a written Guest cancellation notice. If in the unlikely event, the Tour is canceled by PLT and/or Tour Partner, a full refund of Guest’s non-refundable deposit and any Tour payments made to PLT for that Tour will be given within 30 days of that Tour’s departure date. Airlines and other Vendors have their own contracts covering cancellation penalties and other terms and conditions. Guest may be bound by those contracts regardless of whether Guest receives notice of their terms.
Transferring to Another Tour: Guest may transfer their $400 non-refundable deposit to any other available PLT Tour, with a departure date within 1 (one) year of the original Tour’s departure date, with no transfer fee, at the other available Tour’s listed price. If Guest transfers their registration to another available Tour, payment of the different Tour price will be due 60 days prior to that Tour’s departure date, and the Cancellation Fees stated above will apply.
Trip Cancellation, Health, Accident, Medical Evacuation & Baggage Insurance: C0mprehensive travel insurance is highly suggested by PLT and Tour Partner. Unless indicated in the Tour description, travel insurance is NOT included in the price of the Tour.
Smoking policy: No smoking or vaping is allowed on PLT provided transportation or where other Tour members are present, and may only be done within designated smoking areas. Guest agrees to follow all lodging provider’s, and other Vendor’s, smoking policy.
Photography, Video & Testimonials: Any likeness or image of Guest recorded or captured during any PLT Tour, by fellow Guests, PLT employees, contractors or agents, or third parties, may be used by PLT and/or Tour Partner, and a royalty-free license, in perpetuity without charge, in all media, existing now or later developed, for display, promotional or marketing purposes, including without limitation, promotional materials of any type such as brochures, slides, video and/or website usage, is hereby granted by Guest to PLT and Tour Partner. Any written correspondence supplied to PLT or Tour Partner by Guest may also be used for promotional and website purposes as detailed above.
Mobility and Fitness to Travel: PLT Tours are physically active and Guests should be comfortable with 2 (two) hour walking tours at a casual pace and with rests, climbing stairs, boarding and de-boarding various transportation, plus standing for up to 3 (three) hours inside and outdoors, in all weather conditions. Many of the locations we visit may not be ADA compliant, due to “Grandfathering”.
Our Tour Directors, Leaders, Contractors, and Staff are unable to aid Guests with any of these activities. Tour Guests requiring assistance must be accompanied by an able companion who shall be entirely responsible for providing all necessary assistance. We want you to thoroughly enjoy your Tour. If you have any concerns about the physical requirements of a Tour, please contact PLT prior to registering for a Tour.
Tour Guest Expectations: PLT reserves the right, within its sole and absolute discretion, not to accept or retain as a Tour Guest or participant, any person whose physical/mental condition, actions or general attributes impedes, diminishes, detracts or interferes with the operation of the Tour, or negatively affects the rights, dignity, safety, welfare, or enjoyment of other Tour Guests, employees, associates or non-affiliated persons, or for any other reason. If a Guest is required to leave a Tour, for whatever reason, it will be considered an unused portion and non-refundable, and the Guest will be responsible for all of the Guest’s costs, fees and expenses to depart the Tour, including any rebooking fees by airlines and/or suppliers, or Vendors. Only registered Tour Guests may accompany or participate in the Tour. No other persons shall be allowed to accompany the Tour, in any way, manner or form, or participate in the Tour at any location, event or venue, without the express written permission of PLT.
Itineraries are Subject to Change: PLT and Tour Partner will use its best efforts to provide the Tour itinerary and description provided. PLT and Tour Partner will also use its best efforts to provide the products and services of the Vendors listed in the Tour description, or an equivalent. However, a change in Vendor or itinerary may be necessary for a variety of reasons. Therefore, all Tour itineraries are subject to change and no refund will be given for a change in Tour itinerary or Vendor provider.
Entire Agreement: These Terms and Conditions contain all the terms, conditions and provisions agreed to by PLT and Guest relating to its subject matter. It replaces all previous discussions, understandings, guarantees, and agreements. Any other communication, guarantee or agreement relating to such, to Guest by PLT or Tour Partner, its employees, agents, Vendors or contractors is void.
Assignability: Guest may not assign their rights under this Agreement to any other person without the express prior written consent of PLT, or its successor in interest, as applicable. A putative assignment made without such required consent will have no effect.
Written Notices or Requests: All written notices or requests from Guest required by these Terms and Conditions shall be sent via email to: email@example.com.
Claims or Disputes/Arbitration: In the event of a dispute or claim made by PLT, Tour Partner, or Guest concerning, relating or referring to these Terms and Conditions, promotion of Tour, Tour inclusions, performance of PLT or Tour Partner or any claim made against PLT and/or Tour Partner, PLT and/or Tour Partner will make every effort to resolve said dispute or claim between the parties. If the dispute or claim cannot be resolved between the parties, the Guest agrees that all disputes or claims shall be resolved exclusively by binding arbitration according to the then existing rules of the American Arbitration Association in an arbitration conducted in and governed by the laws of Travis County, Texas, USA. In connection with any action or legal proceeding arising out of this Guest Agreement, the parties hereby specifically and knowingly waive any rights that either party might have to demand a jury trial.
Upon making a non-refundable Tour deposit to PLT, you constitute full knowledge, acceptance, and consent by the Guest participant to all provisions in the Tour description; the website, General Information, and Terms and Conditions, the Registration Form, and all other release forms.
